The Presence August 2023 Instagram Sweepstakes

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANT AGREES TO BE BOUND BY THESE OFFICIAL RULES, WHICH SHALL BE FINAL IN ALL RESPECTS.

ELIGIBILITY:

This Sweepstakes is open to legal residents of the fifty (50) United States (including the District of Columbia) and who are 18 years of age or older, as of the date of entry. Employees, officers and directors and their immediate families (spouses, parents, siblings and children and those living in the same households) and their affiliates, subsidiaries, and marketing agencies are not eligible to participate. Void where prohibited by law. All federal, state, and local laws and regulations apply.

SWEEPSTAKES PERIOD:

The Presence August 2023 Instagram Sweepstakes (“Sweepstakes”) starts on Friday, August 18, 2023 at 12:01 a.m. Eastern Time and ends on Saturday, August 19, 2023 at 11:59 p.m. Eastern time (the “Sweepstakes Period”).

HOW TO ENTER:

There are two methods to enter for a chance to win in the Sweepstakes:

(A) Instagram method:

During the Sweepstakes Period, an entrant must:

log into their Instagram account to access Sponsor’s Instagram page;
follow @presencelearning;
locate the ‘August 2023 Instagram Sweepstakes’ post (“Sweepstakes Post);
in comments of the Sweepstakes Post, tag another Instagram account.

An entrant will obtain one (1) entry for each tag in the comments, subject to the eligibility section above. The authorized account holder of the Instagram account will be deemed the entrant and will receive the entries into the Sweepstakes. An “authorized account holder” is the natural person assigned the e-mail address used to create the social media account used to enter the Sweepstakes. An entrant’s use of Instagram’s websites and applications is governed by any applicable Instagram terms and policies.

(B) E-mail method:

For one (1) alternate method of entry, during the Sweepstakes Period, the entrant should email their full name and email address to marketing@presence.com and include “Presence August 2023 Instagram Sweepstakes” in the subject line of the e-mail. E-mail entries must be received during the Sweepstakes Period. The person whose information is set forth in an e-mail entry submitted in accordance with this subsection will be deemed the entrant and will receive one (1) entry into the Sweepstakes, subject to the eligibility section above. Limit one (1) entry per e-mail address in the e-mail received. In the event of any dispute as to the identity of an entrant, the authorized account holder of the e-mail address used to submit the e-mail entry will be deemed the entrant. The “authorized account holder” is the natural person assigned such e-mail address by an Internet access provider, online service provider or other organization (e.g., business or educational institution) responsible for assigning e-mail addresses for the domain associated with such e-mail address.

Any entry that is submitted, regardless of the method, with the use of an automated device will be void. Sponsor reserves the right to disqualify any entry, at its sole discretion, that is not in compliance with these Official Rules. All entries become the property of the Sponsor and will not be acknowledged or returned. An entrant may not enter more than once by creating multiple Instagram accounts and any attempt to do so will result in disqualification.

PRIZE (1):

One (1) Prize winner will receive one (1) Presence-branded coffee mug and one (1) $5 gift card. Total ARV of all prizes awarded: $20.00. Only one prize with be awarded. The winner may not substitute, assign or transfer prize, but the Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. The winner is responsible for all applicable federal, state, provincial and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.

RANDOM DRAWING:

On or about Monday, August 21, 2023, Sponsor will select one winner at random from among all eligible entries received. Odds of winning will depend upon the number of eligible entries received. If a selected winner is not eligible to win the prize, fails to comply with the Official Rules and/or to submit any required documentation within the designated period, declines the prize for any reason, or cannot be reached using the contact information provided in the entry, that winner will be disqualified and the prize will be awarded to an alternate winner in a random drawing from among all remaining eligible entries.

WINNER NOTIFICATION:

The winner will be notified through instagram or through the contact information provided in the entry. The Sponsor will never ask for a credit card number or any other method of payment. Depending of the prize value, the winner may be required to execute and return an affidavit of eligibility, public release (except where prohibited), and a liability release within seven (7) days of issuance. Sponsor may publish the winner’s name on Sponsor’s social media accounts, websites, provider platform, or newsletters. Sponsor is not responsible for any change to entrant’s email or mailing address and/or telephone number.

GRANT OF RIGHTS:

By entering the Sweepstakes, each entrant grants Sponsor and its affiliates, (collectively, the “Released Entities”) the right to use, publish, display, reproduce, modify, edit, and create derivative of the entrant’s name (first name and last name) and information entered in the entry, throughout the universe, in all media and formats, whether now known or later developed, for commercial purposes and any other purposes including, without limitation, advertising and promotion, without further compensation unless prohibited by law.

USE OF INFORMATION:

By entering this Sweepstakes, entrant expressly agrees to receive future marketing communication from Sponsor and will be automatically opted in to receiving such marketing communications. The entrant may opt out at any time via the Unfollow button on the Instagram platform. Additionally, the information that you provide in connection with the Sweepstakes may be used for Sponsor’s internal purposes and may be shared with Sponsor’ affiliates or third parties. GENERAL:

By participating in the Sweepstakes, the entrant accepts and agrees: (i) be bound by these Official Rules and the decisions of Sponsor, which shall be final in all matters; and (ii) to forever and irrevocably release, defend, indemnify, and hold harmless Instagram, Sponsor, and their respective parent, subsidiaries, affiliates, directors, officers, employees, and assignees harmless against any and all claims and liability arising out of the participation in the Sweepstakes or use of the prize; (iii) to the release Sponsor of (i) any lost, late, stolen, misdirected, damaged or destroyed prize and (ii) any errors in these official rules or any marketing material related to the sweepstakes. Sponsor reserves the right in its sole discretion (unless prohibited by law), to cancel, suspend or modify the Sweepstakes, or to disqualify any implicated entrant(s), (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Sweepstakes, as determined by Sponsor at its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to award the prize in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation. In the event this Sweepstakes is canceled prior to the stated end date, a notice will be posted at Sponsor’s social media pages or website.

Please specify “Official Rules” or “Winners List” and the contest name on the front of the envelope. VT residents need not include return postage for Official Rules requests.
